"Visitor survey promotion" Free Prize Draw Terms and Conditions (the "Promotion")
1. TERMS AND CONDITIONS
1.1 These are the terms and conditions (the “Terms and Conditions”) that govern the relationship between you, the entrant ("entrant", “you”, “your(s)”) and the Promoter.
2. THE PROMOTER
2.1 The promoter is: Gusbourne PLC (registered company number: 08225727) of Gusbourne Kenardington Road, Appledore, Ashford Kent, England TN26 2BE (the "Promoter").
3. THE PROMOTION
3.1 The Promotion is open from 09:00 on 19 July 2023 up to and including 23:59 on 17 August 2023, only (the "Promotion Period"). All entries received after the Promotion Period shall be automatically disqualified.
3.2 The entrant must have a valid email address for the duration of the Promotion Period.
3.3 To enter the Promotion via the Promoter's visitor survey, you must undertake the following activities in the Promotion Period:
Complete the visitor survey
Add your email address in the box provided
3.4 One (1) entry per person, only. Entries made through agents, third parties, entry duplication method, delivered late, incomplete, offensive or otherwise not in accordance with these Terms and Conditions will not be accepted.
3.5 The Promoter will not accept responsibility for entries that are lost, delayed, misdirected or incomplete or cannot be delivered or entered for any technical or other reason. Proof of delivery of the entry is not proof of receipt.
3.6 By providing your email address, you are not signing up to the Promoter's mailing list, you are solely entering the competition.
4.1 No purchase is necessary to enter the Promotion.
4.2 The Promotion is open to residents of the United Kingdom aged 18 years old and over, only, who enter the Promotion via the Promoter's visitor survey.
4.3 By entering the Promotion you agree that you have legal capacity to enter the Promotion and agree to the Terms and Conditions (i.e. that you are of sufficient age and mental capacity and are entitled to be legally bound in contract).
4.4 This Promotion is not open to anyone associated with the Promotion; including employees, families or agents of the Promoter, and its associated companies and any advertising and promotional agencies.
4.5 In entering the Promotion, the entrant confirms that they are eligible to do so and eligible to claim the Prizes. The Promoter reserves the right to request that you provide proof that you are eligible to enter the Promotion including providing photographic identification to prove your age.
5. DRAWING A WINNER
5.1 Only one (1) winner will be selected at random from all eligible entries received during the Promotion Period by an employee of the Promoter.
5.2 The Promoter shall notify the winner via email on or after 18 August 2023. If the winner is not contactable within seven (7) days after 18 August 2023, an alternative winner will be chosen at random by the Promoter in accordance with the process described at section 5.1. The winner will need to disclose a postal address to the Promoter in order for the Promoter to forward the Prizes.
5.3 The winner's name will be available on request from 18 August 2023 to 31 August 2023 from the Promoter by sending a stamped self-addressed envelope to: Gusbourne Kenardington Road, Appledore, Ashford Kent, England TN26 2BE.
6. THE PRIZE
6.1 There is one (1) prize. The winner will win one mixed case of wine, containing six (6) bottles. This will comprise (1) bottle of Blanc de Blancs 2018, (1) bottle of Brut Reserve 2019, (1) bottle of Rosé 2018, (1) bottle of English Rosé 2022, (1) bottle of Chardonnay Guinevere 2020, and (1) bottle of Pinot Noir 2020.
6.2 The prize may only be redeemed by the winner himself/herself (who must be at least eighteen (18) years of age).
6.3 The prize is non-refundable, non-exchangeable, non-transferable and cannot be redeemed for cash. There is no cash alternative for the Prizes.
6.4 The prize is supplied by the Promoter. The Promoter reserves the right to replace the prize with an alternative prize of equal or higher value if circumstances beyond the Promoter's control make it necessary to do so.
7. OWNERSHIP OF PROMOTION ENTRIES AND PUBLICITY
7.1 All Promotion entries and any accompanying material submitted to the Promoter will become the property of the Promoter on receipt.
7.4 The winner further agrees to participate in any reasonable publicity required by the Promoter and the winner agrees that the Promoter may use their name and town or county of residence to announce the winner of this Promotion and for any other reasonable and related promotional purposes.
8. LIMITATION OF LIABILITY
8.1 Insofar as is permitted by law, the Promoter, its agent or distributor will not in any circumstances be responsible or liable to compensate the winner or accept any liability for any loss, damage, personal injury or death occurring as a result of taking up the prize except where it is caused by the negligence of the Promoter, its agents or distributors.
9.1 Each entrant agrees to release Survey Monkey from any liability in connection with this Promotion and acknowledges that the Promotion is in no way sponsored, endorsed or administered by, or associated with Survey Monkey.
9.2 The Promoter reserves the right to cancel, amend, terminate or temporarily suspend this Promotion in the event of any circumstances outside the Promoter's reasonable control. If there is any reason to believe that there has been a breach of these Terms and Conditions, the Promoter may, at its sole discretion, reserve the right to exclude the entrant from participating in the Promotion.
9.3 Entrants are deemed to have accepted and agreed to be bound by these Terms and Conditions upon entering the Promotion.
9.4 The entrants' legal rights are not affected. This Promotion is governed by English law and subject to the non-exclusive jurisdiction of the courts of England and Wales.
9.5 The decision of the Promoter regarding any aspect of the Promotion is final and binding and no correspondence will be entered into about it.
