TERMS OF MEMBERSHIP

  1. General
    1. Our contract

      The below terms apply to each membership of Gusbourne Explored and Gusbourne Collectors. You should make sure you have read, understand and agree to these Terms of Membership before you sign up to be a member. Before you can become a member, you will also need to accept our Terms and Conditions of Supply. Once you sign up and become a member in accordance with the below terms, these Terms of Membership will be a binding contract between you and us (Gusbourne Estate Limited) regarding your membership of Gusbourne Explored and/or Gusbourne Collectors (as the case may be).

    2. Eligibility

      In order to become a member, you must be 18 years or older and have a shipping address in the United Kingdom. We reserve the right to ask for proof of age and identification at any time and to deny or cancel any membership if any member or applicant does not meet these requirements.

    3. How to become a member:

      In order to become a member of Gusbourne Explored or Gusbourne Collectors, you need to provide your details by filling out the form at https://www.gusbourne.com/membership including your billing/credit card details. After you have provided your details and confirmed you accept these Terms of Membership, our Privacy Policy and Terms and Conditions of Supply and we have taken payment for your first month or the entire membership year (depending on which membership you join), we will send you a confirmation email to confirm that you have successfully become a member. If you do not receive an email from us, please contact us at membership@gusbourne.com. Please do not assume you have become a member if you do not receive an email. We reserve the right to deny any membership application for any reason at our discretion. Once you receive a confirmation email, you will be considered a member and these Terms of Membership will apply to you and your membership.

    4. Delivery restrictions

      At present, we are only able to offer memberships to customers with delivery addresses in the United Kingdom. We regret that it is not possible to extend subscriptions beyond this geographic limit.

    5. Changing your details

      You may update your delivery and payment details at any time so that your wine will be delivered to an alternative address or using a different payment method. You can either contact us at membership@gusbourne.com or make any updates like this by logging in to ‘My Account’ at www.gusbourne.com.

    6. Other terms that apply to your membership

      Our Terms and Conditions of Supply apply to each membership and form part of our contract with you. By becoming a member, you confirm that you have read and agree to our Terms and Conditions of Supply. If there is any conflict or inconsistency between any terms in these Terms of Membership and the Terms and Conditions of Supply, the terms in these Terms of Membership will prevail. By becoming a member, you also agree to abide by our Terms of Website Use whenever using our website. You should also ensure you have read and agree to our Privacy Policy which explains how we process your personal information and keep it secure.

    7. Changes to these terms

      We reserve the right to make changes to these Terms of Membership from time to time, so please make sure to check back regularly to ensure you are up to date with the terms of our offering.

  2. Gusbourne Explored
    1. The benefits

      As a member of Gusbourne Explored, you will receive:

      • 12 bottles of our still or sparkling new vintage releases per calendar year. 1 bottle will be sent to you each month on or around the third week of the month. You will not have any choice in the wines that are included in your membership and you will not have any right (except as otherwise permitted under your statutory rights) to a refund or exchange if you are not satisfied with any bottle shipped to you as part of the subscription. For any damaged or undelivered goods, the terms in our Terms and Conditions of Supply will apply.
      • Exclusive content sent to you digitally each month.
      • Priority access to ticketed events during your membership.
      • First access to new releases of limited edition wines.
      • An invitation to two members-only parties each year during your membership.
      • One complimentary tasting for 4 people at The Nest (subject to booking terms and restrictions).
      • Preferential rates on our classic sparkling wines (Brut Reserve, Blanc de Blancs, Blanc de Noirs and Rose) during your membership.
    2. Subscription period

      Gusbourne Explored is a monthly subscription plan, charged at a monthly subscription rate of £45 per month for a minimum of 12 months. You will not be charged a higher monthly fee during the first 12 months of your membership, but we may increase the monthly fee after this period at our discretion. We will always give you notice of any changes.

    3. Monthly charges

      On signing up to become a member, you will be charged for the first month of your membership. Thereafter, we will automatically charge your chosen method of payment monthly, on the same day every month until the end of your minimum 12 month membership period, or until you cancel your membership (whichever is later). We have a cut off date of 1st of the month for payments. If you sign up before the 1st of the month, we will send your wine out in the 3rd week of that month. If you sign up after the 1st of the month, we will send you wine out in the 3rd week of the subsequent month.

    4. After your initial 12 months

      We will send you a reminder in the 11th month of your membership notifying you that your initial 12 month period will end the next month. We will also notify you of any changes to the monthly rate at that time. You will have the opportunity at that point to cancel your membership, but if you do not do so, your membership will continue on a rolling monthly basis until you cancel in accordance with the below terms.

    5. Problems with charges

      If we are not able to take payment from you in any given month, we will not send out your wine for that month, nor will you receive any other wine, related materials or any benefits, until payment has been made and your account is up to date. In order to resolve any issues and complete payment, we will attempt to contact you using the most up to date contact details provided by you. If we cannot complete the payment in any given month, your account will be suspended and you will not receive any further wine or benefits until your account is brought up to date and we have updated payment details from you. If we cannot resolve payment issues and your account is in arrears for more than one month, we reserve the right to take formal action against you to recover the remainder of your fees for the minimum membership period which you owe to us in accordance with these Terms of Membership.

    6. Cancellation

      To cancel your membership, you must email us at membership@gusbourne.com by the 15th of the month in order for us to ensure we stop your next payment from automatically going through. If you cancel your membership after the 15th of any given month, you will still be charged for the subsequent month (and will continue to receive your wine and all the benefits for the next calendar month), after which your membership will end. We reserve the right not to renew your subscription at any time without giving any reasons for our decision. We also reserve the right not to authorise a re-subscription.

    7. Early cancellation charges

      Early cancellation charges will apply if you cancel your membership before the end of the 12 month minimum membership period. If you cancel your membership after the minimum 12 month period, no early cancellation fees will apply provided you have cancelled your membership in accordance with the above process. Cancellation charges will equal the total sum of all monthly fees payable to us for the remainder of your minimum 12 month membership period. For example, if you took out a Gusbourne Explored subscription in January, the last month of your minimum 12 month period would be December of the same year. If you cancelled your contract in February, you would still have 10 months remaining in your membership, so your cancellation charge would be the total of 10 months x the current monthly charge (£45) = £450. If you cancelled your contract in November, you would only have 1 month remaining in your membership, so your cancellation charge would be 1 month x the current monthly charge (£45) = £45. The total early cancellation fee will be taken from the chosen payment method on your account when you cancel your membership as stated above.

  3. Gusbourne Explored – annual payment
    1. Subscription period

      Instead of the monthly subscription, you may also choose to sign up to Gusbourne Explored as an annual subscription of £540. You will be charged the full fee for your membership year at the start of your membership.

    2. Automatic renewal

      If you do not cancel your membership before the end of any given membership year in accordance with the terms below, your membership will automatically renew for a further year. You will be charged the full annual subscription fee in the first month of the next membership year. For example, if your Gusbourne Explored annual membership started in June 2022, the last month of the first year of your membership would be May 2023. Therefore, we would charge you for your next membership year in June 2023 (for your membership from June 2023 - May 2024), unless you cancelled your annual subscription in accordance with our cancellation policy. You accept responsibility for all charges prior to cancellation.

    3. Membership renewal

      We will notify you before any recurring fee for your next membership year is billed to you and will let you know if there are any changes to the membership fee. You will have the opportunity at that point to cancel your membership, but if you do not, your membership will continue for a further year in accordance with these terms.

    4. Cancellation

      To cancel your membership, you must email us at membership@gusbourne.com by the 15th of the last calendar month of your annual membership in order for us to ensure we stop your next payment from automatically going through. If you cancel your membership after the 15th of the last calendar month of your membership year, you may still be charged for the subsequent year. We reserve the right not to renew your subscription at any time without giving any reasons for our decision. We also reserve the right not to authorise a re-subscription.

  4. Gusbourne Collectors
    1. The benefits

      As a member of Gusbourne Collectors, you will receive:

      • 12 bottles of an exclusive allocation of limited edition bottles and luxury cuvées. 3 bottles will be sent to you each quarter in March, June, September and December. You will not have any choice in the wines that are included in your membership and you will not have any right (except as otherwise permitted under your statutory rights) to a refund or exchange if you are not satisfied with any bottle shipped to you as part of the subscription. For any damaged or undelivered goods, the terms in our Terms and Conditions of Supply will apply.
      • Exclusive content sent to you digitally.
      • Priority access to ticketed events during your membership.
      • First access to new releases of limited edition wines.
      • An invitation to two Collectors-only events each year (for you and a guest).
      • Preferential rates on our classic sparkling wines (Brut Reserve, Blanc de Blancs, Blanc de Noirs and Rose).
    2. Subscription period

      Gusbourne Collectors is an annual subscription plan, charged at an annual subscription rate of £800 per year. You will be charged the full fee for your membership year at the start of your membership.

    3. Automatic renewal

      If you do not cancel your membership before the end of any given membership year in accordance with the terms below, your membership will automatically renew for a further year. You will be charged the full annual subscription fee in the first month of the next membership year. For example, if your Gusbourne Collectors membership started in June 2022, the last month of the first year of your membership would be May 2023. Therefore, we would charge you for your next membership year in June 2023 (for your membership from June 2023 - May 2024), unless you cancelled your annual subscription in accordance with our cancellation policy. You accept responsibility for all charges prior to cancellation.
