"British Airways The Club Magazine" Free Prize Draw Terms and Conditions (the "Promotion")



    1. These are the terms and conditions (the “Terms and Conditions”) that govern the relationship

between you, the entrant ("entrant", “you”, “your(s)”) and the Promoter.




    1. The promoter is: Gusbourne PLC (registered company number: 08225727) of Gusbourne Kenardington Road, Appledore, Ashford Kent, England TN26 2BE (the "Promotor").




    1. The Promotion is open from [06:00 on 17th August 2021 up to and including 23:59 on 14th September 2021, only] (the "Promotion Period"). All entries received after the Promotion Period shall be automatically disqualified.


    1. The entrant must have a valid, active email address for the duration of the Promotion Period.


    1. To enter the Promotion via the Promoter's website page, you must undertake the following activities in the Promotion Period:


  1. Enter your email into the sign-up form, thereby submitting your email to the Gusbourne mailing list. Entrants may unsubscribe from the mailing list at any time.


    1. One (1) entry per person, only. Entries made through agents, third parties, entry duplication method, delivered late, incomplete, offensive, obscene, pornographic and deemed not suitable for viewing or otherwise not in accordance with these Terms and Conditions will not be accepted.


    1. The Promoter will not accept responsibility for entries that are lost, delayed, misdirected or incomplete or cannot be delivered or entered for any technical or other reason. Proof of delivery of the entry is not proof of receipt.




    1. No purchase is necessary to enter the Promotion.


    1. The Promotion is open to residents of the United Kingdom aged 18 years old and over, only, who enter the Promotion via the Promoter's Instagram page.


    1. By entering the Promotion you agree that you have legal capacity to enter the Promotion and agree to the Terms and Conditions (i.e. that you are of sufficient age and mental capacity and are entitled to be legally bound in contract).


    1. This Promotion is not open to anyone associated with the Promotion; including employees, families or agents of the Promoter or of British Airways, and its associated companies and any advertising and promotional agencies.


    1.  In entering the Promotion, the entrant confirms that they are eligible to do so and eligible to claim the Prize. The Promoter reserves the right to request that you provide proof that you are eligible to enter the Promotion including providing photographic identification to prove your age.




    1. Only one (1) winner will be selected at random from all eligible entries received during the Promotion Period by an employee of the Promoter.


    1. The Promoter shall notify the winner via email on or after [15th September 2021]. If the winner is not contactable within seven (7) days after [15th September 2021], an alternative winner will be chosen at random by the Promoter in accordance with the process described at section 5.1. The winner will need to disclose a postal address to the Promoter in order for the Promoter to forward the Prize.


    1. The winner's name will be available on request from [15th September 2021] to [15th October 2021] from the Promoter by sending a stamped self-addressed envelope to: Gusbourne Kenardington Road, Appledore, Ashford Kent, England TN26 2BE.


  1. THE PRIZE(S) 


    1. There will be a total of two (2) prizes. The winner will win the following prizes:


  1. one (1) bottle of Blanc de Blancs 2016 ("Prize 1"); and
  2. one (1) vineyard tour (winner plus three (3) guests) which will take place at the Promoter's vineyard at Gusbourne Kenardington Road, Appledore, Ashford Kent, England TN26 2BE (the "Vineyard") ("Prize 2").


(Prize 1 and Prize 2 together known as the "Prizes").


    1. The Promoter cannot be held liable for any allergic reaction suffered by the winner or any other person who consumes Prize 1. Please read the product description included on Prize 1 carefully.  This does not however effect your legal rights.


    1. Prize 2 may only be redeemed by the winner himself/herself plus three (3) guests chosen by the winner (who must be at least eighteen (18) years of age). The guests do not need to be the individual named in the entry.


    1. The winner and his/her guests may be required to present personal identification documents at the Vineyard to prove their age and identity.  All other expenses, including without limitation, travel to and from the Vineyard is the sole responsibility of the winner and the winner's guests.


    1. The winner must redeem Prize 2 within [one calendar year] of being notified as a winner by the Promoter. To redeem Prize 2, the winner will need to call the Promoter to arrange the date and time that he/she wishes to visit the Vineyard. The visit will be subject to the Promoter's availability and any visiting restrictions outside of the Promoter's control. Upon visiting the Vineyard, the winner and his/her guests must comply with the Promoter's health and safety instructions.


    1. The Prizes are non-refundable, non-exchangeable, non-transferable and cannot be redeemed for cash. There is no cash alternative for the Prizes.


    1. Prize 2 is not permitted to be used in conjunction with any other promotion, offer or competition.


    1. The Prizes are supplied by the Promoter. The Promoter reserves the right to replace the Prizes with an alternative prize of equal or higher value if circumstances beyond the Promoter's control make it necessary to do so.




    1. All Promotion entries and any accompanying material submitted to the Promoter will become the property of the Promoter on receipt.


    1. The entrant confirms that they give their consent to being added to the Gusbourne mailing list with entering in their email to enter the Promotion.
    2. If not stated otherwise in these Terms and Conditions, personal information collected from entrants about entrants will be incorporated in computerised files belonging to the Promoter, and will be used by the Promoter solely in connection with the Promotion and will not be disclosed to any third party except for the purpose of operating the Promotion and fulfilling the Prizes where applicable in accordance with the respective privacy policy and in accordance with all applicable data protection and privacy laws. Each Entrant has the right to access, correct or delete the information collected and/or processed by the Promoter about himself/herself. Entrants may exercise this right by simple written request sent to [info@gusbourne.com].


    1. The Promoter will only process the entrant's personal information as set out in the Promoter's privacy policy which is located here ("Privacy Policy Link").


    1. The winner further agrees to participate in any reasonable publicity required by the Promoter and the winner agrees that the Promoter may use their name, image and town or county of residence to announce the winner of this Promotion and for any other reasonable and related promotional purposes.




    1. Insofar as is permitted by law, the Promoter, its agent or distributor will not in any circumstances be responsible or liable to compensate the winner or accept any liability for any loss, damage, personal injury or death occurring as a result of taking up the Prizes except where it is caused by the negligence of the Promoter, its agents or distributors.




    1. The Promoter reserves the right to cancel, amend, terminate or temporarily suspend this Promotion in the event of any circumstances outside the Promoter's reasonable control. If there is any reason to believe that there has been a breach of these Terms and Conditions, the Promoter may, at its sole discretion, reserve the right to exclude the entrant from participating in the Promotion.


    1. Entrants are deemed to have accepted and agreed to be bound by these Terms and Conditions upon entering the Promotion.


    1. The entrants' legal rights are not affected. This Promotion is governed by English law and subject to the non-exclusive jurisdiction of the courts of England and Wales.


    1. The decision of the Promoter regarding any aspect of the Promotion is final and binding and no correspondence will be entered into about it.
